Public Offer Agreement

Sole Proprietor Aftanaziv Adrian Zenkovych, acting based on the entry in the Unified State Register No. 20710000000013929 dated 04.10.2010 (hereinafter referred to as the “Contractor”), on the one hand, and any legal entity, sole proprietor, or individual, or their authorized representative, who accepts this offer (hereinafter referred to as the “Customer”), on the other hand, collectively referred to as the “Parties”, pursuant to Article 633 of the Civil Code of Ukraine, hereby enter into this agreement addressed to an unlimited number of persons, which constitutes the official public offer of the Contractor to enter into a hotel service agreement with any Customer. By placing an order and paying for the services, the Customer accepts the terms of this Agreement as follows:

Terms and Definitions

Public Offer Agreement for Hotel Services — an agreement under which the Contractor undertakes to provide hotel services to any person who applies, and the terms of this agreement are the same for all Customers, except for those who are granted privileges under the law.

Acceptance of the Offer — the Customer’s full and unconditional consent to enter into this Agreement in its entirety, without the need for the Parties to sign a written copy of the Agreement.

Hotel Service — the Contractor’s actions to accommodate the Customer or Guest by providing a room (place) for temporary stay at the hotel.

General Provisions

1. This Agreement is concluded by providing full and unconditional consent (acceptance) by the Customer to enter into the Agreement in full.
2. The Agreement has legal force in accordance with Articles 633, 641, and 642 of the Civil Code of Ukraine.
3. By accepting this Agreement, the Customer confirms having read and agreed to all its terms.

1. Subject of the Agreement

Under this Agreement, the Contractor undertakes to provide the Customer with hotel services, namely: temporary accommodation in specially equipped rooms and, additionally, meal services for the Customer or Guests.

2. Booking Procedure

• Booking is made by submitting an oral or written reservation request.
• Upon receiving the request, the Contractor sends the Customer an invoice for payment.
• The Customer must pay the invoice within 3 days of receipt.
• Booking is confirmed only after the funds are credited to the Contractor’s account.

3. Rights and Obligations of the Parties

The Customer shall:

• Pay for the booked services on time.
• Pay a penalty in case of late cancellation or no-show.

The Customer has the right to:

• Cancel the Contractor’s services by timely cancellation of the booking.

The Contractor shall:

• Provide accurate information about the services.
• Receive and confirm bookings within the specified timeframe.

The Contractor has the right to:

• Charge penalties to the Customer for violations of the Agreement.

4. Settlements Between the Parties

Prices for services are set in UAH (Ukrainian Hryvnia) and must be paid within the specified terms.

5. Liability of the Parties

• The Parties are liable for failure to fulfill their obligations in accordance with the legislation of Ukraine.
• In case of failure to provide paid services, the Contractor shall reimburse the Customer the cost of the reservation.

6. Force Majeure

The Parties are not liable for non-performance of obligations due to force majeure circumstances.

7. Personal Data

The Customer and/or Guest gives consent to the Contractor for the processing of personal data in accordance with the terms of this Agreement.
